Terms of Service
These Terms of Service ("Terms") are a legal agreement between you and Examling ("Examling", "we", "us") governing your use of the Examling website and applications (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility & accounts
You must be at least 18 years old (or the age of majority where you live) to create an account. You are responsible for keeping your login credentials secure and for all activity under your account. Provide accurate information and keep it up to date.
2. One account, one candidate
An account is personal to you. Do not share your password or your account: what you practise, what you scored and what you were marked on is a record of one candidate's work, and it stops being useful the moment it is somebody else's too. You may be signed in on two devices at once — a laptop and a phone — and signing in on a third signs out the oldest.
3. Subscriptions, billing & trials
The Service offers a free plan and one paid plan, sold in four fixed lengths: 1 month, 3 months, 6 months and 12 months. All four include exactly the same features; only the length differs. Paid plans are sold and processed by Lemon Squeezy, our Merchant of Record, whose terms also apply to the purchase, and who issue your invoice and handle any tax due in your country. Prices are shown at checkout.
Only the 1-month plan renews. It continues each month until you cancel. The 3-month, 6-month and 12-month plans are a single payment for that period and do not renew automatically — when the period ends, access returns to the free plan and you are not charged again.
- The 1-month plan begins with a 7-day free trial for a first-time customer — an account that has not had a trial or bought a plan before. A payment method is required to start it. If you do not cancel before the seventh day, it converts to a paid monthly subscription at the price shown when you signed up. The 3-month, 6-month and 12-month plans have no trial — they are charged in full at purchase.
- The 1-month plan renews automatically each month until cancelled.
- Paid time stacks. A 3-month, 6-month or 12-month plan bought while paid time is running starts when that time ends, and buying one stops a renewing 1-month plan from renewing again. The 1-month plan can be started only once no paid time is running, so you are never charged twice for the same weeks.
- Applicable taxes are calculated and collected by Lemon Squeezy.
4. Cancellation & refunds
You may cancel at any time; access continues until the end of the current billing period. Refund eligibility is described in our Refund & Cancellation Policy, which forms part of these Terms.
5. Acceptable use
You agree not to: share or resell your account beyond your plan's limits; attempt to bypass usage limits, security, or device restrictions; scrape, harvest, or bulk-extract generated content or answer keys; reverse engineer the Service; misuse it to generate unlawful or harmful content; or interfere with its operation. We enforce plan and device limits and may suspend accounts that abuse the Service.
Plans described as offering unlimited practice or unlimited AI marking are subject to fair-use ceilings on how much new practice is generated in a day and how much AI marking is used over a day and over thirty days. They exist to stop one account being shared or scripted, not to limit your preparation, and they are set far above the heaviest genuine study we have modelled — a candidate preparing for an exam will not meet them. If you do reach one we tell you so, and any work already submitted is still marked. We do not quote the figures here because we tune them; if you believe you have reached one in normal use, contact us and we will look at your account.
6. Content & intellectual property
The Service, its software, design, and brand are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial learning. Practice papers, marking and feedback generated for your account may be used by you for personal, educational purposes.
7. AI-generated content
Practice papers, marking and feedback are produced by automated AI systems. While we apply safety filters and grounding, AI output can contain errors. All scores we produce — IELTS bands, TOEFL 1–6 bands, PTE 10–90, Duolingo English Test 10–160, GRE 130–170 and 0–6, and GMAT Focus 60–90 — are indicative AI practice estimates, not official results, and are not guarantees of any exam outcome. Examling is not affiliated with, endorsed by, or sponsored by the British Council, IDP, Cambridge Assessment English, ETS, GMAC, Pearson or Duolingo, Inc.
8. Availability & changes
We may modify, suspend, or discontinue features, and may update these Terms. Material changes will be posted with a new date; continued use after changes means you accept them.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that it will be uninterrupted, error-free, or that results will meet your expectations.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost data or profits. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms or the law. On termination, your right to use the Service ends; certain provisions survive by their nature.
12. Governing law
Purchases are made from Lemon Squeezy as Merchant of Record, and the sale itself is governed by Lemon Squeezy’s buyer terms. Nothing in these Terms removes any mandatory consumer-protection right you have where you live, including any statutory right of withdrawal or refund. Where a dispute is not resolved by contacting us first, it will be handled under the law applicable to you as a consumer.
